General conditions of sale
Article 1.
The general sales conditions described below detail the rights and obligations of the company a dog in the marsh and its customers as part of the sale of the following goods: animal accessories.
Any performance performed by the company a dog in the marsh implies the unreserved adherence of the purchaser to these general terms of sale after full reading of the elements the grantor.
The customer thus acknowledges to be fully informed that his agreement concerning the content of these Terms and Conditions does not require the handwritten signature of this document, insofar as the customer wishes to order online the products presented in the shop at www.unchiendanslemarais.fr.
Article 2: Articles
The characteristics of the items offered for sale are presented in the catalog section of our site. the photographs do not enter the contractual field. the liability of the company a dog in the marsh cannot be incurred if errors have been introduced. all texts and images presented on the site of the society a dog in the marsh are reserved, for the whole world, under copyright and intellectual property rights; their reproduction, even partial, is strictly forbidden.

Article 3: duration of sale

Article 4: tariffs
The catalog section of our site indicates the prices in euros all taxes included, excluding shipping costs. the amount of the tva is specified when selecting a product by the customer and the shipping costs appear on the screen at the end of the selection of the different products by the customer.
The company a dog in the marsh reserves the right to change its prices at any time but the ordered products are charged at the price in effect when the order is registered.
No discount will be granted in case of advance payment. prices take into account the T.V.A. applicable to the day of the order and any change in the applicable T.V.A. rate will automatically be reflected on the price of the products of the online store. payment of the entire price must be made during the order.
Item 5: order
The products on sale are presented at www.unchiendanslemarais.fret with a description. consumers wishing to buy one of these products can click on their graphic representation. This product is added to its shopping cart, already containing, where applicable, other items that the consumer wishes to acquire and previously placed by himself in his shopping cart. if the summary containing the prices of the goods and the shipping costs as announced elsewhere on the website www.unchiendanslemarais.fr agrees to it, otherwise the customer can simply cancel the order, the consumer can enter its delivery and billing details and then, in the case of a bank card order, click on the logo of the bank establishment of his choice in order to be directed to the secure bank server of the said establishment. Once the payment is validated by the consumer on the secure server of the banking establishment, it has the possibility to return to www.unchiendanslemarais.fr. Once the payment is validated (e.g., transfer, cb), the company a dog in the marsh sends to the consumer a summary of its order by e-mail including the details of the ordered items, the total price ttc (except for the cases provided for in Article 262 ter i of the cgi) including the amount of shipping costs, and the expected delivery times.
Article 6: payment
The consumer expressly declares to have all the necessary authorizations for the purpose of using the method of payment that he has chosen during the validation of his order. it also undertakes to ensure its solvency before any order, in the absence of a dog in the marsh to be able to deliver the products ordered. the company a dog in the marsh also retains the possibility of suspending or canceling any order or delivery in case of refusal of grant of payment authorization from the financial organizations questioned according to the method of payment chosen by the consumer. Item 7: Shipping/Retard
The products are delivered to the delivery address provided by the consumer during his online or offline order, and only in metropolitan, belgium, Luxembourg, Germany, autriche. where the delivery address is different from the billing address, it is appropriate for the consumer to provide these two separate addresses in the order form. It is the same for the consumer to provide any information useful to the delivery during the order in order to allow the carriers to proceed with the delivery. in the event of incorrect or incomplete information that resulted in the impossibility for the carrier to make the delivery, a second delivery will be made after the carrier’s return of the goods to the company a dog in the marsh, this with the prior payment of the amount of new shipping costs from the consumer. the choice of destination country must be made at the time of order. any change of destination, by editing specific document(s) will be billed on a flat basis 50€.
The order will be executed no later than 7 days from the day after the day the consumer has placed his order. in the event of unavailability of the ordered product, especially because of our suppliers, the consumer will be informed at the earliest and will be able to cancel the order. the consumer will then have the choice to ask either an asset of the amount of his order excluding shipping costs, or the refund of the amounts paid within 30 days of their payment, or the exchange of the product.
The consumer must make a dog in the marsh to the company on the same day of delivery or at the latest on the first working day after delivery, any claim of error of delivery and/or non-conformity of the products in kind or in quality in relation to the indications in the order form. any claim beyond that time limit shall be rejected.
In the event of an error of delivery or exchange, any product to be exchanged or refunded must be returned to the company a dog in the marsh as a whole and in its original packaging at the following address: kermorin, 29150 cast. to be accepted, any return must be reported before society a dog in the marsh.
Article 8: withdrawal period
The consumer has a period of 7 working days to return, at its expense, the products not suitable to it. this short period from the day of delivery of the consumer order. if this period expires on a Saturday, Sunday or a holiday or a holiday, it is extended until the next working day. any return must be notified in advance to the company a dog in the marsh by email to info@ucdlm.com. the consumer must indicate in his email his customer number, the number of his order and the reason for his withdrawal. the product must be returned in a recommended package to the following address: kermorin, 29150 cast. only the products returned as a whole, in their complete and intact original packaging, and in perfect condition of resale. any product that has been damaged, or whose original packaging has been deteriorated, will not be refunded or exchanged. this right of withdrawal shall be exercised without penalty, except for return fees. in the case of the exercise of the right of withdrawal, the consumer has the choice to request either an asset of the amount excluding the shipping costs of the order, or the refund of the amounts paid, or the exchange of the product. in the case of an exchange, the shipping will be at the expense of the consumer. in the event of the exercise of the right of withdrawal, a dog in the marsh will refund the consumer within 30 days. the consumer will then be refunded by the credit of his bank account (secure transaction) in case of payment by bank card, or by cheque in other cases.
Article 9: guarantees
Pursuant to Article 4 of Decree No. 78-464 of 24 March 1978, the provisions of the present shall not deprive the consumer of the legal guarantee which obliges the professional seller to guarantee against all the consequences of the hidden defects of the thing sold. the consumer is expressly informed that the company of a dog in the marsh is not the producer of the products presented under the website, within the meaning of Act No. 98-389 of 19 May 1998 and relating to the liability of the defective products. Accordingly, in the event of damage to a person or property by default of the product, only the producer’s liability may be sought by the consumer, on the basis of the information on the packaging of that product. the conditions and duration of the producer warranty are indicated on the product sheets.
Article 10: personal data
In accordance with the law of 6 January 1978 amended by the law of 6 August 2004, Internet users have a right of access and rectification to personal data concerning them. These data are provided only for the purpose of delivering products ordered through the site, by fax, telephone or postal mail. they are obligatory for the processing of their order and any checks made to combat fraud. If optional data were to be collected, the consumer would be notified of this optional nature. the consumer is advised that the refusal to provide mandatory data has the consequences of the impossibility of delivering the products he would like to order. It is also advised that, in the course of the verification of the information provided during the order, the data may be transmitted to third parties for the sole purpose of verification. the consumer has the opportunity to object to the possible transfer to a third party of the personal data concerning him, apart from the third parties responsible for the verification of the mandatory data provided during the order, being specified that this opposition may have the consequence of the impossibility of processing its order. the creation of a customer account on www.unchiendanslemarais.fr results in the customer’s acceptance of occasional promotional offers from the company a dog in the marsh only, being specified that each shipment will contain a disregistration link allowing it at any time to no longer receive these promotional offers. information on the implementation of “cookies intended to enable and/or facilitate the delivery of orders online is available at www.unchiendanslemarais.fr. all requests for clarification of personal data and/or the purpose of the processing, as well as the exercise of the rights of access, rectification and opposition, shall be by e-mail.
Article 11: force majeure
The company a dog in the marsh cannot be held responsible for the non-performance of the contract in case of stock failure, unavailability of the product, fortuitous case or force majeure. shall be considered as a fortuitous case or force majeure all irresistible facts or circumstances, outside the society a dog in the marsh, unpredictable, inevitable, independent of the will of the society a dog in the marsh and which cannot be prevented by the latter, despite all reasonable efforts. the company a dog in the marsh, if affected by such circumstances, will notify the customer within ten working days of the date on which it was aware of it. The two parties will then, within one month, be closer to examining the impact of the event and agree on the conditions under which the performance of the contract will be continued. expressively, are considered as cases of force majeure or fortuitous cases, in addition to those usually retained by the jurisprudence of the French courts and tribunals: the blocking of means of transport or supplies, earthquakes, fires, storms, floods, lightning; stopping telecommunications networks or difficulties specific to external telecommunications networks to customers.
